    1. Clements Loyalty Scheme Terms & Conditions

      CLEMENTS LOYALTY SCHEME – TERMS AND CONDITIONS

       

      Clements loyalty Scheme is operated by Clements Coffee.

      These Terms and Conditions apply to your participation in and use of the features on offer by Clements loyalty scheme at the location at which Clements Coffee provides services to its clients.

      The key features of Clements Coffee Scheme are:

      At participating Locations, you may be able to use a Clements loyalty card and/or Clements loyalty app for the collection and redemption of loyalty points, and to potentially benefit from promotional vouchers at participating Locations. See sections 1 and 2 below for the relevant terms and conditions.

      Use of the Card, the App or other features of Clements loyalty Scheme will constitute acceptance of these Terms and Conditions, which together with our Privacy Policy and Website Terms and Conditions govern our relationship with you in relation to Clements loyalty Scheme.

      You must reside in the UK and be aged 16 or over to participate in Clements loyalty Scheme and access any of the features described above.

       

      1. GETTING A CLEMENTS LOYALTY CARD OR APP

       

      The App is free of charge and can be downloaded from the App Store or if available, via a QR code that may be found on marketing material within our cafes.  Certain mobile devices may not support the App, in which case you will not be able to use it.  You will need to register your mobile device against your Account before the App can be used. You can use the App to create a new Account or you can register the App against your existing Account.

       

      Your Loyalty Card is not a credit or charge card and remains the property of Clements. The Card must not be sold or traded in any way. You must not loan your Card to any other person, it is for your exclusive use.

      You may only use the Card and/or the App at Clements Coffee and Hope Café locations.

      You may cancel your Card and/or delete your App at any time but if you do so, you may forfeit the right to any points that have accumulated on your Account that have not been used.  We may ask you to return or destroy the Card and/or delete the App in accordance with our instructions.

      If your smartphone with the App is lost or stolen or if your Card is lost or stolen, you must notify us of this via the Website.  Clements Coffee will not be liable for any resulting loss of points and/or Vouchers.

      We reserve the right to reject any Cards that become unreadable and also to refuse to redeem any points or Vouchers which have been acquired, or is suspected to have been acquired, via theft, fraud or any other means that are not in accordance with our Terms and Conditions.

       

      1. YOUR LOYALTY POINTS

       

      If you choose to use a combination of the Card and the App, points collected will be accrued to one Account if the Card and App are correctly registered to that same Account.

      Loyalty points can be accrued and redeemed against most products.  We reserve the right to restrict the products against which loyalty points may be redeemed at our discretion. Please ask a Clements Coffee employee for more information.

      Points cannot be accrued or redeemed against any functions.

      The points will be earned at the time of purchase, provided the Card or the App is presented at the point of sale.  If the loyalty terminal is not working and/or if our systems are down due to an event beyond our control, you should still be able to accrue points.  However, we will not be responsible for any loss suffered by you in such circumstances particularly if you are unable (in these circumstances) to collect or redeem points against your current transaction.  If you forget your Card or the App we cannot add points to your Account at a later date.

      Points will accrue on the entire transaction (provided no excluded items/promotions are being purchased).  Points can only be collected against purchases where a till and card reader is present. An Account can hold an unlimited number of loyalty points.

      You can check how many points you have and also redeem points at our cafes.  You can also check the number of loyalty points you have collected on-line by logging into your Account via Clements Coffee website or via the app.

      You will earn one loyalty point for each complete 10p spent on hot & hand-crafted drinks & one loyalty point for each complete 25p spent on food and pre-packed cold drinks.  We may, however, change the number of points you can collect and will display notices at our cafes, should that happen.

      You will only be able to redeem your loyalty points against purchases made at our cafes - each point has a redemption value of 1 pence. The number of points used will be deducted from your Account.

      You are unable to make part payments using your points. Your points will need to cover the full cost of the product being redeemed.

      You will be unable to earn points from any product that has had its standard price reduced due to a promotion, gift vouchers, retails products, vending machine products and hospitality products.

      If you have a discrepancy regarding the number of points on your Account, we may require you to provide receipts as proof of purchase to back up any claim.  If the evidence is satisfactory (to us), we will change the points allocated to the applicable Account to reflect the correct position.

      We will not exchange points for cash and reserve the right to remove from your Account any points that have not been unused on an inactive account for over 6 months.

       

      1. GENERAL

       

      Clements Coffee can cancel or withdraw the Card, the App and/or the Scheme for any reason at any time. In such circumstances, we will endeavour to provide you with as much written notice as possible. 

      We may also change these Terms and Conditions as is necessary by updating them on our Website & app.  You should therefore check the Website & the app from time-to-time to review these Terms and Conditions, because they are binding on you.

      We shall not be responsible or held liable for any default or event arising directly or indirectly from any cause or event beyond our control.  To the extent permitted by law, we also will not be liable for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the App, Cards or Clements loyalty scheme, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the App, this Website or otherwise connected with Clements loyalty scheme.  To the extent that we may be liable, our aggregate liability to you shall not exceed the amount directly paid by you to participate in Clements loyalty scheme.

      If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Terms and Conditions, which shall remain in full force and effect.

      We may transfer the benefits of these Terms and Conditions to a company in the same group as Clements Coffee and if we do so, your rights will not be affected in any way.

      These Terms and Conditions are governed by Northern Irish law and subject to the non-exclusive jurisdiction of the Northern Irish Courts.
